Business Immigration

Business Immigration has seen dramatic changes over the past year.   The path to issuing a business or working visa has become more and more difficult. With many of the most common types of working visas such as the H1b professional visa category having ALL of its yearly allocated numbers absorbed with only a few weeks of their availability. The Permanent Visa (Green Card) Categories have saeen delays and Retrogressions that have caused employment sponsored foreign national workers to wait for 4 to 6 years before they will become eligible for their Green Card.

On the positive side, there has been a huge increase in The Immigration Department?s acceptance of  investment related visa petitions.  The investment option allows a Foreign National to purchase a business in the U.S and in doing so he or she will become eligible for an appropriate visa or Permanent status.

E-2 Visa:

The E-2 visa allows a Foreign National to purchase a U.S business.  He or she will be issued the E-2 visa which will allow the investor to remain in the U.S to mange and operate the business. The Government will continue to extend the E-2 visa as long as the investor owns the business. The inventor?s family members will also be entitled to the E-2 visa.  The average amount committed to purchase a U.S business for the E-2 visa is $300,000 - $500,000. However the visa can be issued to investors with less investment.


EB-5 Immigrant Visa:

The EB-5 immigrant visa is a permanent residency visa or Green Card.  The EB-5 also requires the Foreign National to purchase a U.S business, however the law requires the investor to invest at least $1Million.
